• It is an anonymous work, pseudonymous or a collective work and 70 years have passed since the date of its publication
• It is another kind of work, and 70 years have passed since the year of death of the author (or last-surviving author)
• It is a a posthumous work, published at first time during 30 years and 70 years have passed since the date of its publication

The Article 25.3 (amendment) was added in 2008: “Duration of protection determined by this Law shall be applied to all works of which term of protection has not expired until this Law enters into force”. Works of authors who died in 1970 or earlier, or anonymous works published 1970 or earlier, are public domain in Azerbaijan.

• The protection period continues during the lifetime of the author of the work and for 70 years after his death.
• For works published after the death of their author, the protection period is 70 years after the date of death.
• In cases stated in the first paragraph of Article 12, the protection period is 70 years from the date that the work is published, unless the author of the work discloses his name before the expiry of this period.
• In case the author of the work is a legal person, the protection period is 70 years from the date that the work is published.
